Trucking: tractor was hit by another tractor in parking lot, company fleets, rental tractor


Question
We were hit in the middle of the night by another driver. No injuries just damage to our tractor. The company has paid all damages made to truck but does not want to compensate us. We are Owner Operators and our truck was down for 27 days. They want to pay us for a rental truck, which we cannot do we do not have our own authority, for 6 days at 125 per day. What kind of attorney do we need to hire to get this problem solved? we still have contractual obligations, truck payment, insurance payments etc..

Renee, I'm not sure why you couldn't use the rental tractor to keep running.  The company you are contracted to should not have any problems as long as the truck meets the needs.  This is common practice for both owner operators and company fleets.
