Trucking: my rights as a truck driver, small claims court, practice lawyer

i am currently working for a trucking company in houston tx and the problem i am having is that they are making me drive beyond the legal driving hours. they wont get off my back until i take the load so i do and make the delivery times look legit and the company is coming back on me about why im putting the wrong delivery times on the paper work. i borrowed money to cover fuel on a delivery and a day later they call me and want their money payed back that day or they were going change my pay rate on our CONTRACT.. can they do that???? im thinking about quiting but come to find out when you quit this company they dont pay you your last settlement check and i know this from recent employees quiting. if this is the case when i leave is there any way i can get my money out of the company that is owed to me? in a reasonable amount of time? when being payed on percentage its my understanding its a federal law that they are required to show you the price that they are getting payed therefore i know i am being payed the correct amount off their gross pay. if i am correct where can i pull up this law?

Juan, you didn't state if you are an employee or an owner operator.  Percentage pay is more common for owner operators so I am making that assumption.

As for the other questions make sure you understand the contract you signed.  You may have to sue the carrier in small claims court but you will need to have all of your records in order to prove your case.  If you need an attorney get one who understands transportation law.  It might cost a little more for a specialist but you can't rely on a general practice lawyer to understand the technicalities of federal regulations.  http://www.translaw.org/
