Auto Insurance Claims: umbrella policy, claims advice, claim settlement

Question
I was recently rear ended by a guy who was texting on his cellular phone. He has 250,000 coverage. I have very significant injuries,I.e; Disc herniations, bulging, ruptures, nerve root damage, etc. I was wondering if it is likely that the insured has an umbrella policy in place?how can I find out? I have an Attorney but have also been doing my homework. The owner(s) of the other vehicle are millionaire's and own a very large corporation. Traveler's insurance is their company. They have several other vehicles on their policy as leaked by the adjuster.

Answer
Hello Oscar,
If the value of your loss exceeds or could exceed the $250K coverage, then it is your attorney's job to find that coverage.  An experienced insurance attorney will know how to do this.  If your injuries exceed the $250K coverage and there is no umbrella coverage, again, it would be your attorney's responsibility to determine if the at fault party should be sued personally.  This process usually begins with a basic assets check.

You indicate that the other party has substantial assets.  Chances are, there is probably umbrella coverage.

Let your attorney do his/her job, while at the same time, you need to keep current on their progress.
