Auto Insurance Claims: Settlement value and payment, ligaments and tendons, back and neck injuries

Question
Hello, I had auto accident 5/2008, other party was at fault. I was taken by ambulance to hospital with back and neck injuries. I do have previous back problems. I have had 3 surgeries one on my neck, two on lower back. I have been released from the surgeons, but continue to have trigger point injection in neck and head for torn ligaments and tendons. This has been over the last 1/1/2 after surgery. I see a neurologist for this every 6 weeks (45) injections. I have a lawyer, but question what getting done with it taking soooo! long. The insurance limit of other driver was $100,000, with a million blanket policy. I have $500,000 UIM. I need to see some forward motion on this I have over $200,000 in medical bills, which I have managed to loose my good credit to. I have no personal medical insurance. I go through the VA medical system. Any advise or insight you can give would be greatly appreciated.

Answer
Hi Jeanne,

Unfortunately, these types of claims do take a long time to settle. Your attorney likely is asking for the sun, moon and stars and the claims adjuster is likely offering a grain of sand. To try to get a handle on what is going on, you should request a face to face meeting with youre attorney. Ask your attorney to have your complete file available when you arrive at his office for the meeting. Then when you get there ask the attorney to go over the file with you to make you aware of all offers and counter offers that have occured. Your attorney is most familiar with your case and is in the best position to give you information about your case. Remember the attorney works for you. Treat him like an employee and expect results.

I hope this helps
