Auto Insurance Claims: uninsured, no pay, no play

QUESTION: i was invovled in an accident that was completly not my fault.the guy admitted it was his fault and the police report as well. his insurance company says they will take 90 percent of the respnsiility. little to my knowlegde they lt me kno that my insurance company had dropped me months ago and say they will not pay unless i have insurance. i kno its a no pay no play law in nj but does that not allow me to get money for my car?? will i be ale to get money for my car? what should i do

ANSWER: I think there is a little confusion on the no pay, no play law.  The statutes keeps uninsured motorists (you) from claiming "non-economic" damages.  It means you can't claim pain and suffering or any other damage that is not economic.  It does not keep you from filing a claim for damages to your automobile or property.

Answer
Fight!  Ask them to send you a written denial explaining their basis for denial of your claim.  If they refuse, you can sue the other driver and they (insurance) will have to defend him/her.  If you have a stubborn company, it will take legal action.
