Auto Insurance Claims: auto insurance liability, auto insurance liability

Question
Hello,
My son was a passenger in a vehicle that was at fault in a collision with another vehicle.  The drivers insurance company will pay my son the full amount of the coverage with is $50,000.00 however his medical bills exceed that amount by several thousand dollars and he received nothing for his injuries.  The drivers insurance company said to check with our insurance company because the "under insured" portion should cover him.  My insurance co. says no because he was not driving and it wasn't in one of our vehicles.  We live in California.  Can you tell me if I have a valid claim under our insurance?
Thank You,

Randi

Answer
Uh, Hello Randy,

Well, if your son is a "family member" that lives with you, it's very possible that the coverage (Under Insured Motorist Coverage) would extent to him. Don't take no for an answer. Ask to see where the insurance policy excludes him from that coverage.

You may want to consider talking to a lawyer locally. Please see:

I hope this helps,

Good Luck
