Auto Insurance Claims: Partially denied claim, partially denied auto claim

My wife was in an accident. The other driver turned out in front of her and was given a citation. Her claims department says she was not at total fault and only wants to pay half the damages. My claims department has washed there hands because I only have liability ins. What should I do?

It sounds like your claims department thinks she is half at fault. So find out why they say that and disprove it if you can. Get a copy of the police report. Perhaps the report says both were at fault?

Your claims department is not paying half of the other parties damage because you only have liability insurance, they are paying half because they think your wife was partially at fault.

As to your own damages, if you had collision coverage, your insurer would pay your damages regardless of who was at fault. If you have the UMPD endorsement, then your insurer would pay your collision damages up to a minimal amount like $3500.00 subject to the percentage of fault by your wife.
