Question
I was involved in an auto accident in Sept 2007 when the other driver ran a red light.  I had second degree burns to my hands and have had horrible back pain that is due to a joint that doesn't want to stay in place.  I've had a ton of tests and procedures and my medical bills are approx $40000 and I am still no better today than I was after the accident.  After speaking with the at fault driver's insurance today, I found out they have a $25000 policy limit.  I had med pay on my insurance which has been exhausted and I didn't have uninsured motorist due to a misunderstanding on my part - I was told that I should have med pay instead cause they were the same amount but that med pay would pay immediately - I now know that because I had 100/300 on my insurance that if I had had UM I would be at least be able to cover my medical bills.  I'm at a loss of what to do.  If I sue the other party and the judgement is above the $25k what's keeping them from filing bankruptcy and then having an attorney take 40% of the $25k from the insurance.  Any advise would be greatly appreciative.  Thank you.

I am sorry you are in this situation. You really need to talk to an attorney. The 30 -40% issue here would be on your recovery, but, an attorney can help you decide how to find coverage, other sources of income, and if going after the people that injured you is worth it. Without UIM it will be very hard to handle the matter without an attorney.
