Auto Insurance Claims: Uninsured Motorist problems..., uninsured motorist coverage, minute chase

Okay...on Dec. 9th, I was on my way home with my fiance. We came off an exit ramp from the interstate, stopped at the sign and pulled out onto the road. We drove about 5 yards and a truck pulled out from the right side of the road going left. They stopped in the road and I went under their front bumper. They proceeded to peel out and run. After a 8-10 minute chase with them they went home, the cops showed up and as it turns out...they weren't the owner of the car, didn't have a license and were drunk. When we got home, we filed a claim on our insurance and just had to wait for more info about it. As it turns out...the other car's owner has up to date coverage...and it looked like the accident was going to be covered by the other company...until they found out I had Uninsured Motorist coverage. Can they not cover something just because my insurance can?

Hi Kyle,

No they can not. If the driver of the truck was at fault and the truck was insured then they have to pay. The only exceptions would be if the truck was stolen in which case the owner would have to file a theft report and be willing to have the driver go to jail. The other exception would be if the police excludes coverage if the driver is DUI.

You should demand from the insurance company a written denial of  coverage with a detailed explanation for their decision. Either way you can still go through your own insurance and let your company fight it out with them.
