Auto Insurance Claims: Same Insurance Carrier, insurance carrier, insurance company

My wife was involved in accident where the other driver made a left hand turn in front of her.  Claims were filed by both parties to the same insurer.  The other driver claims my wife was speeding and we claim she was not.  The insurance company has ordered a reconstruction report.  Should we be concerned with the process of determining liability when we are both covered by the same insurer?   How can we be sure a reconstructive expert will make a determination and not result in a decision that is most beneficial to the insurance company, perhaps 50/50?  Will we have access to the report?

This is a common situation. You will likely not be given access to the reconstruction report. It is likely that the adjuster will find some percentage at fault on both drivers. That way they will both be charged with an at-fault event and the insurance company can raise the premiums of both parties.

Unfortunately, there is not much you can do until they make their decision. If the decision comes back with your wife being some percentage at fault, you would have to ask the insurance company what their appeal process is. You can only hope that a higher level of management will believe your wifes story over the other drivers story.
