I was involved in a sideswipe type accident where the other driver swerved into my lane. On the police report the other driver says that I swerved into him to avoid a parked car. I have photographs at the accident showing that the parked car was not in the way.

1. Will the other driver's insurance accept fault if I show them this evidence?

2. On the police report, I only have a policy number for the other party and not the company. How do I find out the insurance company?

Hi John,

There is no way for me to know if the other insurance company will accept your photos as evidence that you were not at fault. You will just have to send them the photos and argue your position.

To find out the drivers insurance comapny you can call the driver and ask him or your can call the police officer and ask him to call the driver to obtain the information. Also you may want to report this to your insurance comapny. They may have a way of determining the insurance company based on the policy number.
