Auto Insurance Claims: Open Driver Side door Impact, double parked, insurance company

I was parked and in the process of exiting my car on the driver side, when a car hit my door and pulled it forward to meet the front fender. The street is wide enough for cars to easily pass when someone is double parked. The insurance company is only willing to accept 10% of damages. I have over $ 2000 in damages. Should I sue them or the driver? Can I win with NY state law about opening driver side door.

Hi Nadia,

This will be a very difficult situation. It is considered to be your responsibility to be sure no cars are comming when you open the drivers door when you are parked on the street. The car has the right of way. You can try to negotiate a better percentage, but you will be lucky to get them to 50/50.
