Auto Insurance Claims: a car accident, little rain, minor accident

Dear expert,

My daughter involved a car accident almost two months ago. A bus hit my daughter's car from behind when the bus tried to swatch the lane, then my daughter's car was out of the control and spun 180 degree, facing the coming traffic.  There is a damage on my daughter's car, which is on the left and back side of the car. The insurance company of the bus driver said it was not the bus driver's fault because the bus driver did not switch the lane and said it is my daughter was out of control. We disagree with this result. But today, we are told by our insurance company that the police said it was my daughter out of the control resulting in her car spun because police said there was no evidence on the road shown the bus switched the lane. The accident occurred on a rain day (a little rain) around 10:40 pm. At that time, there was three buses (heading to the same place) on the left lane of my daughter's car. My daughter is on the center lane which heads to high way. The first bus switched the lane to my daughter's lane in font of my daughter's car. The second bus hit my daughter's car and resulted in my daughter out of her control while the bus tried to switch the lane. After a minute of the accident, the police arrived the scene. The police didn't give the report on the site because he said the accident is minor. He just give my daughter the bus driver license and his insurance company's information and the police' card.

I have a question about the police statement. How can the police could role out the result based on no evidence about the bus switched the lane, while engorged the damage on my daughter's car.

Hi Xiaojun,
In cases of a minor accident, the police usually take a sketchy report at the scene and then 'flesh' it out at the end of their shift, or a day or two later.  This is why it normally takes 5-7 days to get a copy of the police report.

As you are already aware, the police report is the major factor in determining fault in this accident.  Your chances of getting the police officer to amend his report in your daughters flavor are absolutely none.

Your insurance company has no choice but to accept the police report as factual and, although it appears that justice is not being served, you must also accept the report.
