Auto Insurance Claims: Insurance check, renter car, party insurance

My car was totaled after a head on crash, my insurance company has settled with me but I just received a check from the at fault party for damages. I tried to file with the at fault party insurance but after 3 weeks of nothing and no renter car they denied me. So my insurance picked it up, My agent does not know why I received this. The car was totaled and they denied the claim. But they send me damages? Compensation is the only thing we can think of. I did contact the BBB, and made a complaint about the at fault partys insurance, and the adjuster after a week with no call backs from them. And also went past the adjuster and made complaints to the corporate office, and told them I was handing this case over to my attorney. Which was well over 2 weeks ago. Which I decided not to after talking with my insurance agent. I don't want them to come back after me if its found that they made a mistake. Thanks for any advise you can give, John

You should call the adjuster and ask what the payment is for.  I would not cash it without knowing this first.  Make sure you are not recovering twice for the same damages, as you will end up needing to reimburse one of the insurers if this is the case.
