Auto Insurance Claims: Who is at fault?, maughan, insurance rates

I was driving down my road the other day on my way to school. Not but 15 seconds after leaving my driveway one of my neighbors was backing out of theirs and apparently did not see me which in turn resulted in her backing into the front right corner of my car. There was ice on my windshield at the time which did not allow me to see her pulling out of the drive way. Who is at fault?

It sounds like mostly her fault since you had the right of way.  If they claim they were mostly out in the street and you ran into them, it may be a different story.  

If they determine you were less than 50% at fault, it should not affect your future insurance rates.
