Auto Insurance Claims: ex husband borrowed my car, crashed it and fled the scene, blue book value, exhusband

Question
My exhusband traded cars with me for the weekend. Last night, the police phoned stating someone driving my car had wrecked and fled the scene. I later found out it was my ex. He had been drinking and was trying to avoid a DUI. (VA laws)I just paid the balance of my car off 3 days ago. The blue book value is $1600. Police say the damage is extensive. What will his insurance do, what should I do? I have so many questions.

Answer
Hi Rhonda-

Since I only know California insurance not Virginia but it may be the same.
In California, the insurance follows the vehicle.  So as long as you ex is not excluded from your polciy, (you would have had to sign a specific document for this to be the case) your insurance will pay for the damage since he was a permissive driver.
Go ahead and report it to your insurance company and let them know your ex-husband was driving it with your permission.
