Auto Insurance Claims: Brand New 2008 auto totaled, gap insurance, car notes

My car was totaled and I have full coverage plus gap insurance.  The other party was cited and her Ins. Co has accepted full liability.  My Insurance paid their share, over 24.000 but the gap has not paid and I am having to continue paying car notes until it does. Will I be re-imbursed?  If so by whom?  The liable carrier or Gap?  Thank you. Frank

Hi Francis,
Sorry to hear of your problems.  Did you file a separate claim with your Gap insurance?  If not, you need to do so.
There is normally a short time lag while they are learning how much your company paid and the exact balance left owing on the car.
Call your lender to learn if they have even been contacted by your Gap insurer.  If they haven't been contacted and you did make a separate report then you need to contact the Commissioner of Insurance in your state and file a complaint.
Type 'yourstatename department of insurance' into your web browser and hit go.  This will bring up many sites in your state dealing with insurance.  Scroll through this list until you find the on that states 'official site' of the Department of Insurance.  Scroll through that site and you will learn the method of filing a complaint by e-mail and by phone.
