Auto Insurance Claims: Rear end of a car double parked in a two lane street, double parked, comparative fault


Question
I was making a left turn unto a main street.  As I made the turn my vision was obstructed by the bright sun, I rear-ended a car that was double parked, which is a violation in CA to obstruct the flow of traffic.  Here are the problems:
1) The police report does not say that she was double parked (I have pictures) and it says that I am in violation of speed, which is not that case since I was making a left hand turn and could not have been speeding.
2) My insurance company before uptaining the Police report determined that I was at fault.
3)  The other party also appeared to have had the same insurance comany as I do but their policy I was told by my insurance had lapsed.

What liability I'm I facing.  I would think if anything it would be comparative fault.

Hi Nancy,

Unfortunately, any time you hit a stationary object you are considered to be at fault. Even when the stationary object is an illegally parked vehicle. About the only chance you may have for getting some of the liability assigned to the other vehicle is to get the police officer to ammend the police report. But that is a longshot.

As far as what you are liable for; the only damages here are property damage. Your insurance comapny will pay for the damage to the other vehicle and if you have collision coverage, they will also pay for the damage to your vehicle.
