Auto Insurance Claims: Nonpermissive use, payment arrangement, civil suit

I will try to keep this short. Daughters boyfriend gets drunk and takes her car (I own it) and goes for a drive at 4am in the morning. He has not been allowed to dirve the car as I instructed my daughter. He totals the car. I have no collision on the car but do have comprehensive. My caarier said that I need to report it stollen to collect on comprehensive. For this to happen I would have to tell the police to press charges. I am not looking to put him in jail.
Can I get property damage on his insurance policy becuse he totalled my propery? Or what can I do?

Hi Mike,

Unfortunately, auto insurance follows the car not the driver. So his insurance would not cover your car. The only thing you can do is to press charges for theft or you can try to work out a payment arrangement with your daughters boyfriend. If you are unwilling to press charges you can file a civil suit against him and get a judgement against him for the value of the car, although it may be difficult to collect.
