Auto Insurance Claims: liability, person sign, honda civic

About a month ago I was in an accident at an intersection and hit a 1996 honda civic. The other drivers car was totaled and nobody was hurt. My insurance company offered him $5,300 for his car which seems fair. About a week ago I received a letter from the owner of the car I was in an accident with saying that he felt the offer he received from my insurance company was inadequate, he rejected it, and wants around $7,200 total. He is demanding I pay him the difference between what the insurance company is offering and the amount he wants or he will take legal action against me. Does he even legally have a case here?

Hi Jeremy,

You should immediately contact your insurance company and provide them with this information. Your insurance company should have had the other person sign a release form if they have already settled with him. If not then they should handle any disputes withthe person to reach an agreed upon settlement. If your insurance company handles everything as they should, the other person will not have any ability to pursue you for any difference.
