Auto Insurance Claims: car accident, anther, insurance companies

I was in a car accident and totaled my SUV. Anther car was about to hit me on the drivers side of my door trying to turn into my Lane coming from a side street. I was in a 4 way lane, with two lanes in each direction. I was in the 3rd lane she had to cross the other two lanes in the different direction to get into my lane i tried to avoid her from hitting me and swerved over into the other lane witch caused me to lose control of my car. Will her car insurance pay for my car because she was the cause of my accident even though the was no collision??

Hi Darla,

You should try to make the claim against her. However, you should be aware that her insurance company may either try to deny the claim or at least may try to place a percentage of the blame on you, stating that you over reacted to the situation and that is what caused the damage to your vehicle.  This is a ploy often used be insurance companies when there is no direct contact between the vehicles.  If they do try to do this then you should make the claim on your own policy and let the insurance companies agrue it out.
