Auto Insurance Claims: How to Get Vehical Damage from Third Party, response insurance, insurance claim


Question
I was involved in accident due to other persons at fault.She came from rear and hit at over speed.
      I reported to 911 and police came in investigated accident and confirmed that other persons fault.Cop also issued ticket to other person at fault.
      I have collected accident report and initiated insurance claim with her insurance(AAA).
When insurance company tired to reach her,no response.I don't know why she is not responding.When i tired to call her,not picking phone or no response.
Insurance company is saying we can't proceed until she authorize claim.Also they don't know how long its going to take to get hold of this person.
I really stuck in such a bad situation.How to resolve this situation.I don't want to claim my insurance company.

Please help me out.

What they are telling you is correct.  They have to make contact attempts by phone and then mail.  If she still refuses to cooperate after a certain time that varies from state to state, they can then proceed with claim handling or denial.  Legally, they can refuse coverage as she is refusing to cooperate.  This will make her personally liable.  They will tell her this in a letter and this generally prompts people to start cooperating.  They may choose to go ahead and pay the claim based on the police report, but it is the insurance company's option at that point.

You will be better off filing with your own company and then let them go after her.
