Auto Insurance Claims: Car Insurance Claim, car insurance claim, paint and body shop

Okay I want to apologize first because this will be a long one! So here's my issue.. A week ago today I had an accident and when my insurance company (Travelers) came out to look at it they totaled out my vehicle.  At first they told me I had the option of buying back the vehicle and now they are telling me that it's not an option.  They (Travelers) are sending a check for $5600 to my lein holder (Carmax) and then they (Carmax) will send them (Travelers) the title.  Now take into consideration that I still owe on the car and regardless of whether or not I keep the car (which carmax is not concearned with) I will have to keep paying on it and I know this.  I have a family member that owns a paint and body shop who says that he can fix my car, even the slight frame damage for way under what the insurance company said it would cost so obviously I want to keep my car.  I just really need to know what my options are since the insurance company keeps saying something different everytime I offer a solution.... Please Help.

Here's some more info, just basic, that may help you understand my situation a little more.
Name: Stephanie
Age: 22
Residence: Texas
Policy Holder: My mom
Insured as a driver
Vehicle: 98 Chevy Camaro Coupe w/ T-Tops
Accident Type: One vehicle accident
Cars value: $5600, according to Travelers
Cost to repair: $5687, according to Travelers
Cost to repair: $2500, according to body shop owned by my family.
Amount paid to lein holder by insurance: $5600 + some change
Amount still owed by me to lein holder: $8887
Amount Travelers said I could originally buy the car back for: $700, which is the salvage cost.
That's all I can think of ... Please Help!!

Hi Stephanie,

I can not think of any reason in Texas that you can not buy back the salvage. You should call them again and ask to speak to a supervisor or manager. If they tell you you can not buy back the salvage, tell them to put it in writing with the exact explanation of why you can't.  Then for verification you should call the Texas Department of Insurance to ask them.
