Auto Insurance Claims: reinbursment for rental, car accident, timely manner

I was in a car accident and the other person was at fault.  Their insurance says that since they have declared my car a total loss, in Texas, they don't have to reimburse me for my car rental.  Is this true?

I cannot speak for TX but in my state, it is partially true.  From the time that the vehicle has been deemed a total loss forward, they owe no rental.  Most companies will provide 2-3 days as a courtesy.  From the time of the accident until they look at the car, they owe reasonable rental.  Reasonable means a few days.  The claim must be reported in a timely manner.
