Auto Insurance Claims: Damage to our auto by a stolen car, crime victims fund, dodge avenger

Question
My daughter's car was severely damaged by a stolen truck whose driver escaped on foot after smashing into our parked car.  The police came, the true owner came (he had indeed reported the car stolen that morning).  We live in Oklahoma and only carried liability insurance on the car (and uninsured motorist which I believe only covers bodily injury).  The car is a 1998 Dodge Avenger and the damage is sure to be in the thousands if it is not a total loss.  Do we have any options or are we just out of luck and the loss is ours to bear?

If they find the thief, my guess is he's not going to have any insurance.  If he is a teenager, though, could we claim against the family, assuming no other options are available to us?

Thanks for your answers and help.

Answer
Hi Bob,

Unfortunately I do not gave any good news. The person who owned the car is not responsible for the damage caused by the thief so his insurance company will not pay any claim.

Oklahoma does not have Property Damage Uninsured Motorist coverage.

About the only thing I can suggest is that you contact your City Attorney or perhaps your State Attorney to see if the city or state has a crime victims fund. In some states there is a fund that victims of crime can make claim to for some kind of payment. I'm not sure how much you can get or if it even would apply in this situation.

I hope this helps
