Auto Insurance Claims: Insurance claim, commercial policy first party damages

Question
Our company truck, trailer (12') and equipment were involved in a rollover, one car accident.  The truck and trailer were total losses and the replacement value approved on both.  However, the proprietary business equipment loaded in the trailer is NOT covered, according to the Commercial carrier, Farmer's.  We were told by the Farmer's Agent, specifically, that the equipment would be covered in an accident (in a meeting several months ago). We are out of business until and unless the equipment is replaced. We have been told by others that the business equipment is definitely covered. We are only asking for what we were told we were insured for, nothing more.  We would have carried additional coverage, if it was needed, but the agent was asked about this and he said we would be covered.  Your help is appreciated.

Answer
This answer can only be answered by a review of the applicable policies.  These types of claims can be very complicated depending on what type of policies are in force.  I'm afraid that if I were forced to guess, I would say that somebody is missing something somewhere for sure.  Normally, equipment that is being hauled / transported is covered by either the carrier or transporter, depending the existense of or type of relationship between the two.  I hope that makes sense, and I know that this isn't answer.

We will discuss your case with you for free, but you need a copy of the applicable policies.  If you need help obtaining that information, I suggest you hunt down a specialist.  Information is always free at Petty Details, LLC.

Sorry I didn't have an easy fix, but I will say it needs investigating, property that is being transported is covered somewhere almost always, just needs a good looking at by somebody that knows where to look.
