Auto Insurance Claims: Insurance company refuses to pay storage and towing to lienholder, state insurance department, storage fees

In May 2011, I was in an accident in my city of Charlotte NC.  My insurance company determined it was my fault. They went on to settle the claim. Now, my lienholder won't release the title or vehicle to the insurance company because they haven't issued  him a check. ALso, the insurance company is refusing to pay the towing and storage fees.  I, as well as the lienholder have been contacting the insurance company for weeks, and no one was getting back to me.  Now, the insurance company wants to pick up the car, but hasn't made payment to the lienholder, although they have my power of attorney for which they said they needed.  I feel like I am caught in the middle here. I don't know what the law says about the insurance company having to pay storage and towing in North Carolina. Help! Thank you!

Based on your description, the insurer is acting in bad faith.  Call the insurer and ask to speak to the manager.  Politely but firmly demand action on each issue.  Do not yell, this will not help.  If the manager does not help, call the state insurance department and file a complaint.
