Towing Issues: dui tow, tow truck driver, small claims court

recently i was pulled for a dui.In chesterfield Virginia.  As soon as i was released I went straight to impound for my vehicle. Upon arriving I found there were no keys. Their story is the officer lost them. First they said there were no keys, story soon changed to -they asked officer for them when they picked vehicle up and officer did not have them.  yet i was in the police car and never  saw a tow truck driver. After speaking with officer i learned the officer did not have them either. So all i know is everything i had on me was inventoried so i am not responsible.  two weeks have gone by and they will not yet take responsibility for my keys.  i am losing work and business. meanwhile my car sitting for two weeks with windows down.  I had to drive there myself in rain to put tarp over windows. One lawyer said i should get vehicle towed to my house.  the way i see it, once its at my house, i am responsible for any damages.  Another lawyer said i should get a key made, i am thinking thats accepting responsibility and i will be expected to pay 2 weeks of impound fees.  should i get a lawyer? who is responsible?

Responsibility or not, I would get it out of there as fast as possible as the cost goes up each day it is in the tow yard.

Keys do get lost all the time as officers do work together and have at times taken over on the impound part from the arresting officer, and that is why you might not of seen the tow truck...

And then there are also the problems with tow trucks taking vehicles to yards which have a high volume of vehicles towed.  Things get tagged wrong at times and that could be the whole problem...

I would do what the lawyers say though and get it out and then you can go the small claims court route for any and all damages you think that you had happen to you or the vehicle... But remember that you need lots of documentation to do that...

As to paying the fees, well yes you as the vehicle owner are responsible for any and all towing and storage fees... And be aware that after the vehicle has been in the tow yard for a period of time they file a lien on the vehicle and gain legal title to the vehicle.

If you do not get it out you might lose it for good.
