Towing Issues: Unprofessional behaviour & illegal/wrongful doing from tow truck driver, tow truck driver, dot number

Question
Hello Richard,
The below incident occurred in Baltimore,MD on July 19 2008. I was in a Burger King parking lot. I had just finished and was getting out of the establishment when I noticed a tow truck towing away my van. I immediately approached the driver and asked why he as towing the car and asked him to stop. The driver did not say anything nor did he stop. There was heavy material in the back of the van and the towing process has caused some damaged to the bottom of the car. I asked the man to stop several times but in vain. The driver did not make eye contact nor did he say anything, except that the car needs to be taken to the autopark and that I was illegally park. The van was very legally parked in the customer parking lot at Burger king. Within a few minutes the tow truck driver got on the phone and when he hung up, told me 'oh wrong parking lot' dropped the car in the middle of the road and just left. No apology, no explanation. How do I file a complaint, who do I file a complaint with? how do I stop such a driver from being out on the road causing more damage to other people? Please advise. I do know what towing company that is, and I have the license and DOT number as well. IF proof is required I also took a picture of the driver towing my car away. Thank you much for your assistance regarding this matter.Jeyan

Answer
Well this happens from time to time where the tow truck does attempt or tows the wrong vehicle... Yes it seems like it was a mistake...

Now as to the damages, well I assume that you know the company who did it and have attempted to contact them with it... Even if they  did not charge for the service and such they still should accept responsibility for it.

I would see what they do and if they accept the responsibility...

As to the "stopping the driver from doing further damages" well its kind of hard to do as we all know that accidents happen and even if they are the greatest tow truck drivers, sometimes we just have a bad day...

Now if the tow company is aware of the driver and his "damage record" it might be were he is let go for safety reasons... It all depends on how the tow company owner feels about the issue.

If not then there is always the small claims court route.
