Towing Issues: illegal tow, california state laws, gov pubs


Question
an individual in our private community (Association) phoned in a false abandoned car report to the local police dept. She convinced the police that she was a board member and got the vehicle towed out to storage. The streets are "private" property, (not dedicated to the city). The vehicle was not abandoned and was not violating any California state laws. The PD later admitted it was a bad tow.  Can the owner of the towed vehicle sue the individual who called in the false report?

Answer
YES the California Vehicle codes have a "responsibility section" where the person who authorized the tow is responsible for "damages and fines" on illegal tows...

if I am not mistaken in its in section 22658...
