Towing Issues: Towing vehicles from a privately owned easement, car ports, property deed

Hi,

I'm wondering if someone can help me resolve a long standing issue ?

I live in Seattle and own a townhome that has an easement running to it from the main street. The easement is part of my property. It is included in the property deed of my townhome and I pay taxes based on this.

There are other townhomes adjoining mine and some apartments on the opposite side of the easement. Our easement grants these people ingress and eagress to their respective garages and car ports.

We have had issues in the past with tenants from the apartments parking on the easement, right outside our house, despite the proliferation of "No Parking" signs.

My question is that as the technical owner of the easement do I have the right to have these vehicles towed if they persist in parking there ?

If so, at what point does niceness (putting a note on the windshield) give way to action (having the vehicle towed)? How many times can they do it before I can have them towed ?

well this is a can of worms, and reason I am saying this is if the "easement" grants rights to get to the property and they are parked on the easement but still partially on "their property" you can see the headache..

I know its not much of an answer, but I would check with the Police department and then with a lawyer as it is one of those gray areas in towing which I prefer to avoid towing from...

Shared driveways, easements all mean that someone else has control, and while you pay the taxes on it, you are still the owner. But you have "granted them access" and while parking is not access it becomes the "I was just going in to open the garage door type issue...

I wish I could provide a better answer, but remember one thing, for each vehicle towed, a signed authorization needs to be done, and the person authorizing the tow, can still be held responsible and taken to court to try and shift blame to them even though the tow was justified and legal...
