Towing Issues: Existing Issue Exacerbated by Tow Driver, tow driver, drivable

Last spring I had to have my 4Runner towed. It had little transmission fliud in it, and wasn't drivable. When the tow driver went to load it up, I told him it wasn't drivable. He told me that since it was running he was sure it would be fine. I reiterated it isn't drivable. So he jumps into my car and goes to drive it on, and I have to stand there and watch him rev the hell out of my car to get it onto the bed. Eventually he gives up and uses the cable to pull it on, like he should have from the beginning. Now I have transmission issues from the transmission being overheated during this saga, and I may have to replace the transmission. Is this something that the tow company could be held liable for if my mechanic can tell me that's is probably when the damage was done to my transmission? It's been less than a year since this occurred, and it's getting worse over time. What should I do?

well, since the vehicle was low on transmission fluid as the orginial problem, you do not think that any harm happened at that point do you...

Trying to load the vehicle by driving it on the truck (I was not there so I do not know what really happened or how long he tried to do that), most likely was like 1 minute or so before he gave up...


Now anytime transmission fluid is low, you do not lube the gears as needed and that can also lead into the unit not working properly. Transmissions are real temperature sensitive...

Now you say last spring this happened, well I think it would be hard to prove that they did cause this as it has been a year. Generally it takes a short time to show up and cause damage...

Now I am thinking (my thoughts here) that something is wrong again (is the fluid level ok, has the transmission been serviced, filter changed (we are talking about an automatic transmission correct)...

There are a lot of issues here which could be causing this to happen. But I really doubt that something a year ago is causing it now...
