Towing Issues: Damage to my Impounded car, garage keepers insurance, tow company

Question
Hey Richard. I recently got my car towed but when I gathered the money to pick it up there was a BIG problem! Apparently someone else was more upset than I was at the owner and broke all the car windows on all the cars and pored paint remover on all the cars that were impounded too!!! The also broke the owners shop windows!!! The impound does not have a secure gate around the cars and they say they have no leads to who did this!!! My question is this, are they responsible for all the damage to my vehicle while it was on there property and under there control? Someone needs to pay for this!

Answer
they should have insurance which covers this kind of issue and while they will try to deny the claims it most likely will not hold up in a court...

If it was towed and stored at the tow company then it becomes a "issue of possessionary responsibility" and that is where the laws will work either for you or against you...
Their garage keepers insurance should be the area which it is covered by. But then again, not every City or State requires every kind of insurance and then there are also people who do not have the required insurance either.

But I know it sounds a bit dumb but if you do not have any luck with the tow company taking responsibilty for the damages (even if they do not know who did it)  then a very good option is to take and contact your insurance company and have them work for you on this issue...
They have a bit more experience dealing with damage claims and they have a whole bunch of lawyers on staff who do this kind of thing...
