Towing Issues: towing of cars from Visitor spaces, mobile home park, homework question


Question
Background: I live in a mobile home park in Gilroy, CA. When the park was built 30+ years ago, each lot was paved with a tandem two car driveway. Over the years as old single wide coaches have been replaced with newer, larger double and triple wide units some of the driveways have been shortened or narrowed making it difficult to impossible to park two vehicles. As this has occurred, residents have taken to parking in the rarely utilized "Visitor" parking spaces about the park. While there is still plenty of parking within the park, management has decided to start towing residents that are parked in visitor spaces. Residents are not issued parking permits, however we do register our cars with the park office. In the past residents have been told that they may park in the visitor spaces if they have an elderly visitor parked in their driveway. It is a fair trade off. But this advisement is not written, it has only ever been verbal.

So now for the questions:
1) Are these "Visitor" spaces considered "Common Area" and does the park have the right to selectively tow? That is if two resident cars are parked side by side, both in visitor spaces. Can the management choose to tow one and not the other?
2) How must a "Visitor" space be marked (striping, labeling, signage, etc.)?
3) If two spaces are side by side and one is labled "Visitor" and the other is not does one have reason to believe that the unlabled space is not reserved?
4) Does the management need to investigate the situation to verify an elderly visitor trade off, since it is not a written park rule.

Well this will tend to be more of a homework question as it covers a lot of issues...

Verbal agreements are real hard to enforce and over time they have a habit of changing...

California has a huge amount of rules on this issue and the DMV website has lots of sections covering all kinds of issues on parking space marking, sizes, along with towing issues..

I wish I could really help with the answer, but it has so many variations of issues and what if's then it would be best for you to look a bit and see if you can narrow it down a bit.
