Towing Issues: Towing Issue, tow truck drivers, tow truck driver

Out $130 and wasn't even hooked up. But paid due to not knowing the Law!!

I wanted to know if it is legal for me to get in my car and drive away if the car has not been hooked up yet, but the tow guy is in the process of extening the lift arm to put under my car. Also, If they tried to stop me from driving away with physical force or with continuing to proceed to try and hook my car up with a mechanical arm and caused damage would I have a case against them?

I am not sure what the law states in your case, but common sense tells me that (unless your car was ordered towed by a law enforcement agency due to expired tags, etc.) if the vehicle is actually moving and the tow truck driver hasn't hooked it up yet, it wouldn't seem legal to pursue the vehicle. Tow truck drivers are NOT law enforcement agents, therefore, they have no legal right to pursue anybody they wish who is driving an automobile. I hope this helps. If, in fact, the driver of the tow truck caused damage to your vehicle while trying to do what you say he tried to do, then my guess is you would have a case against the owner of the tow company. It would help if you had any eyewitnesses to what actually happened. Good luck to you! If you feel it necessary, you may wish to file complaints with whatever agency(ies) investigate tow operators. Perhaps criminal charges are warranted. It's a good thing nobody was hurt.
