Tips on Buying Cars: recovered theft wrecked car, dealer ship, auto auction

Hi.  I purchased a car two years ago through my father's dealer ship.  He had purchased it from an auto auction and was sold as a green light car.  It had only 7,000 miles on it when I purchased it.  I went to trade my car in and the new dealer indicates my car was stolen recovered and wrecked but was never reported to dmv.  This shows on car fax.  The dealer said I need to go back to where I bought it from.  The auction did not want to help me since it was 2 years.  They said I only had 90 days to report a problem like this.  I filed a complaint agaisnt the dealer in nys that brought it to the auction after her repaired it and the state said there is nothing they can do for me.  I paid 14,000.00 for this car and now is worth hald what I bought it for.  The auction also told me I can resell it there but would have to annonce what the other dealer did not.  Anything that you can help me with I would appreciate.  Thank you vin# 2g2wp522651211172

DISCLAIMER:  I'M NOT AN ATTORNEY, AND AM NOT QUALIFIED TO OFFER LEGAL ADVICE.  Having said that, what you're describing is a case of fraud on the part of the dealer that brought it to auction.  Hard to blame the auction- they can only go by what the seller tells them.  If the seller says to green-light it (and there's nothing on the title to indicate any problems), then that's what the auction has to do.

Your only recourse at this point is to hire an attorney and take the dealer (who brought the car to auction) to court.  I would imagine that he'll also bring suit against the auction; not that you really want to sue them, but just the threat of a legal action will certainly induce them to want to cooperate with you and your attorney.  Regardless, you need to prove that the original dealer was the one that committed fraud.  If they can prove that they're innocent, that they were duped (most likely if it was traded in by the original owner), then you would then have to go after the person that duped them.
