Tips on Buying Cars: Purchased a DEALER CERITIFIED WRECKED Vehicle, car fax report, vehicle history report

Question
Hello I purchased a 06 Honda Civic Si Dealer certified Vehicle with 7000 miles on it in 05/07. I was given a Clean AUTO CHECK vehicle history report on the vehicle upon purchasing. At about 34,000 miles I noticed the right rear tire was bald the other 3 were wearing evenly, I purchased 4 new tires Dealership recommended the brand I had a 4 wheel alignment done at this time as well. I have the tires Balanced And Rotated every 5,000 miles as well as a oil change. 10,000 miles on the new tires the service tech tells me that the right front tire has flat spots and that could be because of a weakened suspension. Dealership inspected vehicle and stated that the tires are feathering but to drive it another 5,000 miles and we will recheck it. I have a vibration in the front and the steering wheel pulls to the right. I have had 3 alignments in 6 months and the tires balanced and rotated every 5,000 miles. So after all this i finally ran a car fax report to discover the vehicle had been wrecked (Hit a Guardrail) located former owner and was told when he traded the vehicle to another dealership that yes they ran a car fax report 6 months earlier and that carfax did show the accident. 1 of this dealerships Certification process is a clean CAR FAX REPORT not Auto Check. I informed the dealership that 1 they sold me a wrecked vehicle and 2 they did not provide me with a clean car fax report and that my vehicle has some sort of damage  I asked the salesman on the day of purchasing if the vehicle had ever been in a accident and was told No. The dealership is refusing to do anything about this My buyer guide states they will cover 100 % of parts and labor on any repairs but i am not happy that i purchased a wrecked vehicle The dealership is willing to trade for a 09 Si but wants me to pay 6,000. difference I offered them 3,000.00 but they are not willing to deal I have an appointment in the morning to have the frame checked to see what if any damage is done to the Frame. ANY Advice or Any Suggestions on this matter would be greatly appreciated. I did not agree to purchase a wrecked vehicle and The Corporate office says yes that i should have been given a Car Fax report but it is between me and the dealership to resolve this issue and the General Manager's stance on the problem is That i haven't been hurt physically so what is the harm!! Please any advice i live in TN Thanks

Answer
Hi Debbie

Damage or no damage to frame is not the issue, you been sold a car without full disclosure, where I am located you would be intitled to a full refund, I dont know the laws of TN but here is a link to make contact to know your rights    http://lawyers.findlaw.com/lawyer/practicestate/Auto-Dealer-Fraud/Tennessee

The dealership is trying you on for size. If I was in your shoes I would approch the matter with a short detailed registered letter to the GM stating

(1) I was never provided with a clean history report, and will persue a full refund
(2) The salesperson informed me vehicle has never been in an accident " that's misrepresentation "
(3)  General Manager's stance on the problem is That i haven't been hurt physically so what is the harm!! I wonder how the justice system deals with a statement like that ?.

Unless we can come to a mutual agreement I see no other direction than to contact legal advice, please contact me within 7 days to resolve this matter or your dealership will be served with court action.

PS... Was there frame damage ? keep me up to date,,, when you reply check the make private box
