Penalty for an Expired License in Florida

In Florida, you must have a valid and current license to drive. If a Florida police officer catches you driving with an expired license, you face a fine and in some cases, jail time. The exact fine can vary depending on your county, but generally the Florida state statutes apply.

Monetary Penalty

  • The state of Florida classifies driving with a license that has been expired less than six months as a traffic infraction and charges a $30 fine. Along with a fine, you receive three points on your driving record. If you can prove that you did indeed have a valid license at the time of the incident, a Florida clerk of the court may dismiss the case and charge a fee of $10.

Increased Penalties

  • If your driver license is expired longer than six months, Florida considers that a second-degree misdemeanor. A second-degree misdemeanor has a penalty of up to 60 days in jail, six months’ probation, a $500 fine or a combination of the three, up to the discretion of the court.
