Auto Insurance Claims: auto accident, insurance claim liability

I am the owner of the car my daughter is driving. On 2/4/10 my daughter was in a car accident with that car. The other driver pulled out in front of her from a bank entrance. My daughter was on a main 4 lane highway. The other driver received a ticket. He went to court and was found guilty. The other drivers insurance (a high risk ins. co.)denied claim stating their insurer said it was not his fault. (The other drivers ins. co said our car is worth $1800.) When I told them I would contact my attorney, the insurance co. then offered me half which she said would be a deduction of $300 (I don't understand that)so they offered $750. The repairs on the car is $3000.00. I strongly beleive we should be paid for what the car is worth. Please advise....What really upsets me when you are involved in an accident and it is not your fault you end up taking money out of your own pocket. I had an accident a few years back and my car was totalled. I ended up with a new car payment. My other car was paid for. Thank you so much for any advise you can provide.
