Auto Insurance Claims: release of all claims, total loss, value

I was involved in an accident that was clearly the other operator at fault. I reported to my insurer and they sent an adjuster who Total Lossed my vehicle. There are Medical, Loss of Work etc....to be completed with the other operators Insurer, but if I settle on the Loss of my Vehicle with my Insurer,( which the value of my vehicle was quite low ), will I then be unable to negotiate a reasonable amount for a replacement vehicle from the other drivers insurance company???  Thank you from Arizona!

I'm not sure I understand the question.  Is the insurance company offering to pay pay you less than the fair market value for your vehicle?  If they are offering you less than it's worth then you should work it out with them directly.  If they are paying you fair market value for the car then I'm not sure what claim you'd be looking to make against the other driver's insurance...

In other words, if you've been made whole by receiving the full value of your car then you probably can't take another bite of the apple.  As with almost all things in the auto insurance area it's really best for you to speak to an attorney in Arizona.
