While driving north bound on a hwy, a vehicle came across the median from the south bound lane and totaled my girlfriends 2007 Kia Rio. She owes $10,997 and the Blue Book value is listed at the same price. The drivers insurance sent a settlement offer of $7,000. What can we do?

If you cash the check, make sure there is no release on it. If there is, just line it out, initial it, and on the back of the check write "partial payment of claim" and sign below that and deposit it.
