Auto Insurance Claims: 3 car accident, insurance co, merry christmas

Question
Hi,

I was invloved in a 3 car accident, a car pulled out onto the highway and hit a car in the rear and caused that car to crash into me , in my lane. My truck received the most damage. I have a claim against the car that hit me. But.. her insurance co states it's the driver that hit her that I should go after. I was told that it is a chain effect. She hit me not him. So that is why I have the claim against her.

Is this how it works ?

Thanks for your help.

Answer
Hi Christina,

Yes. It is the person who started the chain that is responsible for the damage to all of the cars.

Think of it this way, if you were driving down the road and suddenly someone ran into you pushing you into another car, do you think you should be responsible for the car you were pushed into. Of course not. The person who hit you is responsible for the damage to your car as well as the car they pushed you into.

I hope this helps
Merry Christmas
