Auto Insurance Claims: Auto Transport Claim, auto transport company, better business bureau

An Auto Transport Company damaged my vehicle in a cross country move.  The damage is about $5000.  They admitted fault and I have a police report proving the admission. I have talked to their insurance company several times, but they refuse to submit the claim until their insured files the claim.  When I talk to this auto transport company they tell me that they have submitted the claim.  The insurance company is telling me that they haven't. Somewhere someone is not telling the truth here and I believe it's the auto transport company.  Is there any way I can go after the insurance company?  I have a police report where they are admitting guilt, how can the insurance company deny the claim?  I had a $1000 deductible at the time of the damage and no rental coverage.  That means it would take about $2000 out of my own pocket if I go through my insurance company.  Please help.  I have tried to involve the better business bureau and a lawyer and I am still at square one.

Hi Barry,
I strongly recommend that you file a claim with your own insurance company.
That doesn't mean that you must have them repair your car, but since you carry full coverage and they are in a position where they are legally obligated to repair your car, this gives them a legal interest in the case and they can work on your behalf by dealing with the transport company and their insurance carrier.
This is much better than using all your efforts and the other resources that you mentioned.
