Auto Insurance Claims: drunk driving hit and run, eye witness, own insurance

My vehicle was in front of my home and was hit and run by a drunk driver that eventualy stopped after coming to rest on a nieghbors yard after hitting thier car.  The damage to my vehicle was not apparent unitl 2 days later and the actualo cause was not discovered for 5 days.  the cause was determined by my insurance company.  there were no eye witnesses, however the evidence and damage is proof of what happened.  The police will not include my damage in the report with the drunk driver due to the time frame of me reporting and the fact that there is no eye witness.  are the police acting correctly.  I live in NJ where corruption rans wild...help!

The police are acting correctly. Since there was a delay in your report and no witnesses there is no actual proof that it is related to the drunk driver. You should make the claim to your own insurance, explain the situation to them and they may try to get reimbursed from the other insurance company.
