Auto Insurance Claims: accident injury scar ??, soft tissue injuries, whip lash

Question
I was in an accident 2 months ago with my 8 year old son.We were not at fault the liability is very clear.
We were struck by an 18 wheeler that ran a red light. His statement at the scene was "I had a heavy load and could not stop". and the other brilliant comment was "people should be more aware of big trucks that cant stop with heavy loads in intersections". He was trying to run a yellow.
I had neck and back injuries, soft tissue, whip lash  and 6 stitches above my eye where there is a very obvious scar about a half inch in and above my eyebrow. my son had severe neck pain but not until the next day.
The insurance company has been very fair so far with my truck claim even though I do not have an attorney.she offered to give me  the highest amount for my totaled truck nada value.
My questions are:
How do I determine the value of my injuries when there is an obvious scar that is permanent.
Is there a way to look up case injury law comparable to my case.
How should I determine my 8 year olds injury claim is it going to fall under the same guidelines as mine.He had only 15 degrees of motion in his neck the days following the accident. However he was never medivaced to the hospital as I was.He was never even checked out.As a matter of fact he was left at the scene with the officer until family could pick him up.I was out of sorts for a few days when I finally realized he was injured I took him to the doctor. who has determined He has a pinched nerve and whip lash.
Do you think I should be handling this on my own.
Help!!

Answer
Hi Debbie,

Injury claims are generally settled as a multiple of the medical bills. For soft tissue injuries the range is usually 2 to 5 time the total of the medical bills depending on the severity of the injury and the length of treatment. In the case of a permanent scar on the face (again depending on how severe and obvious) the range may be 4 to 10 times the total of the medical bills.

These type of claims can be tricky and difficult to handle on your own. I would recommend that you at least interview a couple of attornies to get their take on the value of your claims.

I hope this helps
