Towing Issues: Vehicle towed by someone else, small claims court, mechanics liens

I sold a snow plow to someone who took my truck to take the wiring harness, while in his possession he said that he had to put a ground wire on it and sent me a bill for 291. I told him I would not pay this until he had proof. I went to pick my truck up today and found out that he had it towed by a local towing company. I did not authorize it to be towed and was never notified by the towing company. Am I responsible for the storage fees and can I recover them from the person who had it towed.

unfortunately the vehicle owner is responsible for towing and storage fees, but it sounds like the person who did the work was a repair shop or at least trying to be one.

Now, legally they can have the vehicle removed from property they own or control, but if he had it towed as part of trying to get you to pay the $291.00 then he might of got into some legal areas which some are gray and some are solid.

Mechanics liens are good in most all states, but you were correct in asking for a receipt or proof of work done.
Towing liens for the towing and storage are also good in many states, but if the rules were not followed according to state law, you did not tell me what state it happened in then you might have grounds for getting it back with him paying.

Now you always have the small claims court system which you can use, but it can turn into a "he says, they say" kind of deal which Judges really hate to see in their courtroom.

Good luck and my best advise is pay the towing and storage fees, do not pay anything else if it pertains to the "REPAIRS" as that can not really be collected by the tow company for the other person.
Then go the legal routes and see what your luck is like in court.
