Towing Issues: Tow operators responsibility for damages to vehicl, tow truck driver, tow operators

Would you say it's the responsibility of an individual tow truck driver to pay for damage to a bumper of a 1970 Pontiac or the responsibility of the Towing Company (who carry insurance)? The reason for asking is a tow truck slid on some ice while pulling out a car, just bumping the bumper %26 taking some paint off of an already damaged bumper. The vehicle owner has contacted the towing company stating $1500 in damages %26 the owner of the company says the employee is responsible %26 will take it out of the drivers pay %26 suspended the driver for 3 days. Just curious as to what your take on this would be?  Advice would be greatly appreciated. Thank you.

If the driver is an employee then the towing company is ultimately responsible. Whether they want to file it with their insurance company is completely up to them as long as they take care of the damage. I don't see $1500 in damages to a 1970 model vehicle, but I am not there to see it. If the driver is a contractor then the towing company is still ultimately liable unless they have documentation releasing them.
