Tips on Buying Cars: Dealer denies problem with new vehicle, 2008 mercedes c300, mercedes benz usa

I purchased a 2008 Mercedes C300 in Nov. Two weeks later I took it back because it drives rough and the bottom scrapes the sidewalk, making an audible sound, when I park in my driveway. The service dept. said nothing was wrong. On 24 December I took it in again because all of the coolant had leaked out. I was given a loaner while the C300 was being repaired. The loaner, a 2007 C250 drove so well, and so much better than my C300 that my anger at not having my new car for the holidays dissipated. I again complained about my new vehicle but the sales person told me that it's not their fault if the vehicle doesn't drive right, it's Mercedes-Benz' fault. I don't want the car anymore because after driving the other Mercedes, I am absolutely SURE that something is wrong with mine. I even tried to return it and get the 2007 model but the dealer wanted to sell me the older vehicle with the same terms. (the new C300 has 760 miles on it) What recourse do I have?

Hi Sandra,

This is a terrible situation you're involved in. Unfortunately, it sounds like the dealership is hoping you'll get frustrated enough to disappear.

It sounds like you do have some valid concerns with your new C300 and I would not take this laying down.

I would suggest reaching out to Mercedes Benz USA corporate office and explain to them that your C300 is basically a lemon and you're tired of taking in for service.

I would also stress the fact that you will exercise your rights to use the "Lemon Law." You should have received some documentation regarding this consumer protection law when you purchased in November.

This is a little painstaking process to utilize the "Lemon Law," however you will avoid losing money when you trade your newer vehicle in for a year older one.

I would also suggest that you should try to make an appointment, or better yet; just show up at the dealership and asked to speak to the dealer him or herself. Make sure you've got your gameplan together. And that should be to either make your 2008 right, or trade it in with no money out of pocket. You may have to get out of your comfort zone and really be demanding and expect results. Remember, you are the customer and you deserve to be satisfied with your investment!
