Towing Issues: illegal towing and lien, lease purchase agreement, mercury cougar

Hi I have a question.
My car a 1972 Mercury Cougar was towed. It was parked in the back of my complex (not an apartment, purchased townhouse)for about 2 weeks. About 2 weeks ago it got a flat tire, i had to order a new one. While I was out of town, my car was towed (7/1/2009). When I came back on the 7th I was told that a notice was put on the car (while I was away). Today I got a first letter from the towing company saying that they had put a lien on the car and will be selling it in August.  I am right now doing battle with my Home owners association since it was them that authorized the tow I think they should pay to get the car out.  What is the best course of action to deal with this as far as the tow yard goes.  That car has had only one owner and that was my grandfather.  It has extreme value to me personally.  I dont want it to get sold.  I just found out about tow and have every intention of paying the ENOURMOUS fee they are asking from me.

best advise I can give is "PAY NOW, and fight in court later"


Reason I say this, is that the HOA will drag their feet on this issue and the tow company will not release the vehicle without payment from someone.

If you pay and get it back then you can fight in small claims court and such. But I am going to guess that the HOA will claim that the vehicle is not up to "COVENANTS and RESTRICTIONS" in the lease - purchase agreement.

A HOA is the worst offender in my book for stupid and silly requirements.

If they want to say that only purple cars can park on Tuesday between 3 and 4 PM then that is the law !!!!!
