Towing Issues: colorado private request rules, colorado state patrol, drug screens

CAN YOU PLEASE TELL ME WHERE TO GO TO FIND OUT IF THE COLORADO STATE PATROL CAN KICK ME OFF THE SCENE OF A PRIVATE REQUEST TOW AFTER AN ACCIDENT. WHEN THE STATE PATROL SHOWS UP THEY SAY THAT BECAUSE MY COMPANY IS NOT ON THE RETATION THAT, EVEN IF THE CLIENT REQUESTS MY COMPANY, THEY HAVE TO CALL THE NEXT COMPANY ON THE ROTATION. WE HAVE DEVELOPED A STRONG REPUTATION FOR RELIABILITY AND SAFETY IN OUR SMALL COMMUNITY, AND PEOPLE WANT US TO DO THEIR ACCIDENT RECOVERIES. WHERE CAN I GO TO FIND OUT IF WHAT THE STATE PATROL IS TELLING US IS TRUE?

I understand your frustration. This still happens to towers who are on the rotation! First lets go into some details since I don't live in Colorado and know ALL the statues. Does your state have a towing board which regulates public safety towing? Public safety towing includes accidents and most emergency towing situations. Most states have a form of rules and regulations for public safety towing such as finger printing, drug screens, background checks, secure faculties, licensing and permits. They will know the answers and point you in the right direction. Also here is the state code and has tons of information. You will have to do some digging and the information is there http://www.michie.com/colorado/lpext.dll?f=templates&fn=main-h.htm&cp=   and click on the revised statues and scroll down to title 42 article 4 for starters. The state code doesn't flow as easily as most so take your time. Do not limit yourself just to vehicles and traffic also search in other places such as title 43 and elsewhere. Also, I'm unsure if this is the case but if the police authorized tower beat you to the scene and started the recovery then you would have lost out anyway. I'm just being up front and know it SUCKS! I could have used some other expletive. It has happened to ALL of us who have been doing this for awhile. Could your company qualify for state police towing? If it does get it done!
